The Activation fee covers both our service and the approximate tax recovery charges for local government tourism taxes bed taxes or value-added taxes that RedeemVacations.com pays to its vendors (e.g. hotels/resorts)
The activation fee is non-refundable you have 18 months to choose travel destination and travel dates. Once travel dates have been selected and confirmed no changes
You acknowledge that RedeemVacations.com pre-negotiate certain room rates with hotel suppliers to facilitate the booking of your travel incentive and additional reservations. You also acknowledge that RedeemVacations.com provides you services to facilitate such booking of reservations for a consideration (the "facilitation fee"). The room rate displayed on the Website is a combination of the pre-negotiated room rate for rooms reserved on your behalf by RedeemVacations.com and the facilitation fee retained by RedeemVacations.com for their services. You authorize RedeemVacations.com to book reservations for the total reservation price, which includes the room rate displayed on the Website, plus tax recovery charges, service fees, and where applicable, taxes on RedeemVacations.com services.
You acknowledge that except as provided below with respect to tax obligations on the amounts we retain for our services, RedeemVacations.com does not collect taxes for remittance to applicable taxing authorities. The tax recovery charges on prepaid hotel transactions are a recovery of the estimated taxes (e.g. sales and use, occupancy, room tax, tourism bed taxes, excise tax, value-added tax, etc.) that RedeemVacations.com pays to the hotel supplier for taxes due on the hotel's rental rate for the room. The hotel suppliers invoice RedeemVacations.com for certain charges, including tax amounts. The hotel suppliers are responsible for remitting applicable taxes to the applicable taxing jurisdictions. RedeemVacations.com does not act as co-vendors with the supplier with whom we book or reserve our customer's travel reservations.
This incentive activation is FINAL & NON-REFUNDABLE end user will have 18 months to travel and can choose from all available destinations to find travel dates and participating resort/hotel options. Once travel dates are confirmed no changes will be allowed. Cancellations after dates are confirmed will result in forfeiture of the activation fees. (The inventory used for these rooms are not as flexible as booking at regular retail rack rates, once confirmed changes will not be allowed and cancellations or no-shows will result in forfeiture of fees paid) If optional upgrades are selected the cancelation or rescheduling policies will depend upon the individual participating hotel.
LIMITATION OF LIABILITY. As a condition of use of the Service, and in consideration of the Services provided by the Company, User agrees that neither the Company, nor any officer, affiliate, director, shareholder, agent, contractor or employee of the Company (the "Company Affiliates"), will be liable to User or any third party for any direct, indirect, incidental, special, punitive, or consequential damages, loss of profits, loss of earnings, loss of business opportunities, damages, expenses, or costs resulting directly or indirectly from, or otherwise arising in connection with the Service, Site or Content; including but not limited to any of the following: Reliance, Termination, Infringement, Force Majeure. The limitations set forth in this section apply to acts, omissions, negligence, and gross negligence of Company and/or the Company Affiliates, which, but for this provision, would give rise to course of action in contract, or any other legal doctrine. The Company shall not be liable for any direct, indirect, incidental, punitive, special, multiple, or consequential damages resulting from the use or inability to use the Services or for cost of procurement or substitute goods and services or resulting from any products or services purchased or obtained through the site including loss of profits, use, data or intangible property, even if the Company has been advised of the possibility of such damages. The entire liability of the Company and Your exclusive remedy with respect to the use of the site and service are limited to the lesser of (1) the amount actually paid by You for the Service during the three (3) months preceding the date of Your claim; or (2) US $500.00. You hereby release the Company and the Company Affiliates from any all obligations, liabilities and claims in excess of this limitation.
